  • “Payment Instrument”: Credit card, debit card, bank account, UPI, IMPS, prepaid payment instrument, or any other payment method offered by banks/financial institutions.
  • “Platform”: The website or application where the Merchant offers products or services.
  • “Transaction”: An order/request placed by the User to purchase products/services through the Platform.
  • “Transaction Amount”: The monetary amount paid by the User relating to a Transaction.
  • “User/Users”: Any person availing services/products on the Platform.
  • “Website”: www.instamojo.com or the associated mobile application.

3. Merchant’s Rights

You agree that we may collect, store, and share information provided by you for fulfilling Transactions and contacting you regarding the same.

4. Your Responsibilities

You agree to:

  • Provide complete, true, and up-to-date information necessary for completing Transactions (e.g., name, email, address, phone number, age, gender, etc.).
  • Provide accurate payment details using legitimate and authorized payment sources.

5. Prohibited Actions

You shall NOT:

  • Use the Platform for any unauthorized commercial purpose.
  • Retrieve content/data to compile databases without written approval.
  • Misuse the Platform for fraud, hacking, impersonation, or unauthorized account creation.
  • Interfere with security features or operation of the Platform.
  • Use bots, automation scripts, data mining, or extraction tools.
  • Upload harmful content such as malware or spam.
  • Harass, threaten, insult, or harm employees, users, or the Merchant.
  • Reverse engineer, copy, or tamper with Platform software.
  • Violate applicable laws or publish defamatory, abusive, or illegal content.

6. Limitation of Liability

If you receive a defective product/service, your sole remedy is to request a refund subject to the refund terms.

You agree to indemnify and hold the Merchant harmless from any claims, losses, costs, or damages arising from your misuse or breach of these Terms.

7. Guidelines for Reviews

While posting reviews, you must:

  • Have genuine firsthand experience of the product/service.
  • Not post offensive, discriminatory, illegal, misleading, or abusive content.
  • Not be affiliated with a competitor while posting negative feedback.
  • Not manipulate or organize review campaigns.

We reserve the right to accept, reject, or remove reviews at our discretion.
By posting a review, you grant us a worldwide, royalty-free license to use, reproduce, modify, display, and distribute the content.

8. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.
  • Courts in Bengaluru, India will have exclusive jurisdiction.
  • Any dispute shall be resolved through arbitration in Bengaluru, in accordance with the Arbitration and Conciliation Act, 1996.
  • Arbitration language: English.
  • Arbitration proceedings shall remain confidential.
  • Each party bears its own arbitration cost until awarded otherwise.

9. Grievance Redressal

For queries or complaints relating to orders, refunds, fraudulent or unauthorized transactions, please contact our designated grievance support team.

10. Disclaimer

  • By initiating a Transaction, you enter a legally enforceable contract and agree to pay the price listed using authorized payment instruments.
  • Payment details may be shared with third parties for fraud verification or legal compliance.
  • We disclaim liability for unauthorized use of payment instruments, transactional failures, errors, or losses caused by system issues.
  • You are responsible for maintaining confidentiality of account information (order ID, password, etc.).
  • The Platform content is for general information only and does not constitute professional advice.
  • We do not guarantee that the Platform will be free from errors, malware, or vulnerabilities. You must use appropriate cybersecurity measures.
